NORTHERN MARIANAS HOUSING CORPORATION (NMHC) COMMUNITY DEVELOPMENT BLOCK GRANT –
DISASTER RECOVERY (CDBG-DR) FEDERAL CROSS-CUTTING REQUIREMENT PRESENTATION ON SECTION
3, DAVIS BACON AND RELATED ACTS (DBRA), ENVIRONMENTAL REVIEW PROCESS, FAIR LABOR, FAIR
HOUSING & NON-DISCRIMINATION, AND WOMEN AND MINORITY OWNED BUSINESS ENTERPRISES.

The Northern Marianas Housing Corporation (NMHC) is conducting a Federal Cross-Cutting presentation for all interested
contractors planning to conduct business with the NMHC. The U.S. Department of Housing and Urban Development (HUD)
encourages all HUD funded programs to comply with these requirements.
Section 3 is a provision of the Housing and Urban Development Act of 1968. The purpose of Section 3 is to ensure employment
and other economic opportunities generated by certain HUD financial assistance shall, to the greatest extent feasible, and
consistent with existing Federal, State and local laws and regulations, be directed to low-and very low-income persons,
particularly those who are recipients of government assistance for housing, and to business concerns which provide economic
opportunities to lowand very low-income person.
Davis Bacon and Related Acts: require the payment of prevailing wages to laborers and mechanics employed on the site of the
work of certain federal or federally assisted contracts for construction, alteration, or repair.
An Environmental Review is the process of reviewing a project and its potential environmental impacts to determine whether
it meets federal, state, and local environmental standards. The environmental review process is required for all HUD-assisted
projects to ensure that the proposed project does not negatively impact the surrounding environment and that the property
site itself will not have an adverse environmental or health effect on end users
The Fair Labor Standards Act (FLSA) is a federal law which establishes minimum wage, overtime pay eligibility, recordkeeping,
and child labor standards affecting full-time and part-time workers in the private sector and in federal, state, and local
governments.
The Fair Housing Act (FHA) is a federal statute that prohibits discrimination in the sale or rental of housing, as well as in
residential real-estate related transactions such as advertising, mortgage lending, homeowner’s insurance and zoning.
As a recipient of HUD financial assistance, NMHC CDBG-DR is required as the non-Federal entity to take necessary steps to
ensure that all Subrecipients, Contractors, subcontractors, and/or developers funded in whole or in part with CDBG-DR financial
assistance ensure that, when possible, contracts and other economic opportunities are directed to small and minority firms,
women-owned business enterprises (WBEs), and labor surplus area firms.
